GENERAL CONDITIONS OF SALE
Art. 1 - Acceptance of the general conditions of sale and conclusion of the contract
The contract stipulated between Silvia Gnecchi and the Customer (ie the subject, an individual, who
make a purchase on the Site, not related to your commercial, business or
professional) must be considered concluded with the acceptance, even if only partial, of the order
by Silvia Gnecchi. In case of non-acceptance of the order, Silvia Gnecchi
will in any case promptly notify the Customer.
By placing an order in the various ways provided, according to the present order form
on the Site (hereinafter the "Order"), the Customer declares to have read all the information
provided to him during the purchase procedure and to fully accept these
general conditions (hereinafter the "Conditions").
These Conditions may be printed or saved on a durable medium, in
compliance with the provisions of art. 12 of Legislative Decree 70/2003 and by art. 51 of Legislative Decree.
206/2005, as amended by Legislative Decree 21/2014.
Art. 2 - How to purchase
The products offered for sale by Silvia Gnecchi are only those present on the site of
Silvia Gnecchi at the time of placing the Order, as described in the relevant cards
informative.
In any case, it is understood that the images accompanying the description of a
product are for informational purposes only and may not be perfectly
representative of its characteristics but differ eg. by color and size (also
by reason of the browser and monitor used for accessing the Site and viewing
of images).
To place an Order, the Customer must fill in the relevant form in its entirety present on the Site and send the same after having carefully read the Conditions,
as well as the characteristics of the product and / or products it intends to purchase. The client
he must also ask Silvia Gnecchi, if desired, to issue a tax invoice
relating to the purchase, pursuant to art. 22 DpR n. 633/1972.
Correct receipt of the Order is confirmed by Silvia Gnecchi through an answer via
e-mail, sent to the e-mail address supplied by the Customer. This message of
confirmation will briefly report the purchase conditions, as required by law
applicable, as well as the data entered in the Order by the Customer, so that the same can verify
the same and possibly communicate without delay the necessary corrections of incorrect data.
Art. 3 - Prices and Payment Methods
The prices indicated on the site are to be considered inclusive of taxes and VAT.
Any shipping costs or payment costs are communicated in any case
in advance to the Customer through the site or these Conditions.
The following payment methods are envisaged:

PayPal
For the payment the customer can use the Paypal second circuit
the specific modalities of the same
◦
Credit card
In cases of purchase of goods with a credit card payment method,
the transaction can take place through the secure Paypal server or other server
sure chosen by Silvia Gnecchi. In no case and at no stage of the
payment Silvia Gnecchi will be able to know the related information
to the Customer's credit card, transmitted via connection
protected directly on the website of the bank that manages the transaction.
No computer archive of Silvia Gnecchi will keep such data and therefore
in no case Silvia Gnecchi can be held responsible for
any fraudulent or illegal use of credit cards by third parties
upon payment
Delivery of products and related costs
The purchased products will be delivered to the address indicated by the Customer in the Order within
7-10 working days, after 24-48 hours from the date of registration of the Order by
Silvia Gnecchi, at the cost specifically indicated on the Site before sending the Order.
Silvia Gnecchi reserves the right to accept or not deliveries requested outside the borders
Italian or European. In any case, for deliveries to be made outside the Italian borders, the costs
shipping and delivery times may vary.
With regard to deliveries requested in countries outside the European Union,
any import customs fees will be borne by the recipient. It invites
therefore the customer to contact the customs authorities of his country in advance for
check the costs and any import limits.
The delivery times indicated by Silvia Gnecchi must be considered as purely
indicative and a delay with respect to them, or any delivery made with
subsequent split shipments do not entitle the customer to refuse delivery
itself and to the request for compensation or indemnities.
Upon delivery of the products, the Customer is required to check:
◦
that the number of packages delivered corresponds to what is indicated in
transport document.
◦
that the packaging is intact, not damaged or wet or in any case
altered, even in the closing materials (adhesive tape or strapping
metallic).
Any damage to the packaging and / or the product or the mismatch of the number
of packages or indications, must be immediately detected, affixing one
specific indication on the delivery document of the product to be returned to the courier.
Any problems concerning the physical integrity, correspondence or completeness of the
Products received must be reported within 3 days of delivery, according to
the procedures set out in this document.
Art. 5 - Right of withdrawal
Pursuant to art. 52 of Legislative Decree 206/2005, as amended by Legislative Decree 21/2014,
the Customer may withdraw from the Conditions and therefore from the purchase contract for
any reason, without the need to give reasons and without any penalty, within 7
(seven) working days from the date of receipt of the products.
To exercise the right of withdrawal referred to in the previous article 5.1, the Customer must send to
Silvia Gnecchi a communication to that effect, within the terms indicated, below
email address orders@silviagnecchi.com , or use the appropriate form on the
Site.
In case of withdrawal, the Customer must return the products to our warehouses within 7
(seven) days from the withdrawal itself, to the following address:

The goods must be returned intact, complete with all its parts and in packaging
originals (envelopes and packaging), kept and possibly used for the time
strictly necessary to establish and verify its nature, characteristics and
proportion, according to normal diligence, without any signs of wear or dirt,
in compliance with the following conditions:
◦
the right of withdrawal may apply to the product purchased in its entirety;
in fact it is not possible to exercise withdrawal only on part of the product
purchased (eg: accessories, complements, etc ...);
◦
for the withdrawal to be possible, the product must be intact and returned
in the original packaging, complete in all its parts (including packaging and
any documentation and accessory equipment: labels, tags, tags,
seals, etc ...);
◦
the shipment, up to the certificate of receipt in the warehouse
indicated by Silvia Gnecchi, is under the complete responsibility of the customer;
◦
in case of damage to the goods during transport, Silvia Gnecchi does
will notify the Customer, to allow him to promptly protrude
complaint against the courier chosen by him and obtain the relative
reimbursement; the product will then be made available to the Customer,
at the same time canceling the request for withdrawal;
◦
Silvia Gnecchi will not be liable in any way for damage, theft,
loss occurred during or in any case depending on the shipment for
the restituition.
◦
Silvia Gnecchi will refund the Customer the full amount already paid
net of any additional shipping costs pursuant to art. 56,
paragraph 2, of Legislative Decree 21/14, within 14 (fourteen) days of withdrawal, through
procedure for reversing the amount debited, using the same means as
payment used by the Customer for the initial transaction, unless otherwise
agreement. In any case, the Customer will not incur any costs as a consequence
of this reimbursement, except for the return costs in the event that it is not used
of the standard procedure indicated or in the event that the return does not arrive
from Italy.
Silvia Gnecchi may suspend the reimbursement until receipt of the
returned product or until the moment in which the Customer proves to have
correctly returned the product, if earlier.
In any case, the Customer will lose the right of withdrawal in cases where Silvia Gnecchi ascertains
that:
◦
the returned product and / or its accessories, and / or its packaging are not
intact;
◦
the product is missing its external packaging and / or internal packaging
original;
◦
the product is missing its integral elements and / or accessories (eg.
closures, laces, buckles, etc.).
◦
the product is missing the disposable seal
In case of forfeiture of the right of withdrawal, Silvia Gnecchi will return to the
sender of the purchased product, charging the shipping costs to the same and, where already
refunded, the price of the product.

Art. 8 - Privacy
The personal data collected with the forwarding of the Order will be processed by Silvia Gnecchi al
only for the purpose of satisfying the express requests of the customer, in compliance with Legislative Decree 196/2003
and the privacy policy on the site. Any further treatments will come
carried out only with the express consent of the Customer.
Art. 9 - Applicable law
The sales contract referred to in these Conditions and its execution e
regulated by Italian law, with the non-application of the conflict rules and the
United Nations Convention on the International Sale of Goods. For the solution
the relevant disputes will be the competent court of the municipality of residence of
Customer.
Art. 10 - Copyright
Brands, logos and other distinctive signs on the site belong to their respective owners. IS'
the use of trademarks, logos and other distinctive signs, including reproduction on other websites, is prohibited
by unauthorized third parties. The contents of the site are protected by copyright (texts,
images and graphics).
Art. 11 - Agreement
The contract replaces all previous contracts, agreements and understandings between the parties e
constitutes the entire agreement between the parties regarding the subject of the contract, together with the order,
the general conditions relating to the use of the site and the conditions relating to the service
registration. Any variation or modification of the contract must be accepted in writing
from both sides.
Art. 12 - Communications
All communications between the parties must be made in writing and sent
at the address of the other party indicated in the contract and in the order. They are intended to be sent by
also writing communications sent to the e-mail address of the other party,
indicated on the site and in the order.
Communications relating to the validity or existence of this agreement must
be exclusively delivered by hand or sent by registered letter
with Acknowledgment of Receipt.
Art. 13 - Language
The sales contract is drawn up in one version: Italian.
